Forland Trever Daniel LLC (“Vinkoprints,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same.   5. Statement of Accuracy and Authority: A statement, made under penalty of perjury under the laws of the United States, that: (a) the information contained in your DMCA Notice is accurate and truthful; and (b) you are the copyright owner or are authorized to act on behalf of the copyright owner with respect to the copyrighted work(s) identified in your notice.

  6. Your Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. For electronic signatures, a typed full legal name is acceptable if submitted via email.

B. Submitting a Counter-Notification

If you believe that material you posted on the Site was mistakenly removed or access to it was disabled as a result of an error or misidentification, you have the right to file a counter-notification with our Copyright Agent. Your counter-notification must include the following information:

  1. Identification of the Material: A clear description of the material that has been removed or to which access has been disabled, including the exact location (URL) where the material appeared on the Site before it was removed or disabled.

  2. Your Contact Information: Your full legal name, mailing address, telephone number, and a valid email address.

  3. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which Vinkoprints may be found).

  4. Agreement to Accept Service of Process: A statement that you will accept service of process from the person who provided the original DMCA notification (the complaining party) or an agent of such person.

  5. Statement Under Penalty of Perjury: A statement, made under penalty of perjury under the laws of the United States, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.

  6. Your Signature: A physical or electronic signature of the user providing the counter-notification. For electronic signatures, a typed full legal name is acceptable if submitted via email.

Upon receipt of a valid counter-notification that meets the requirements outlined above, we will promptly forward it to the original complaining party. The DMCA allows us to restore the removed material, or re-enable access to it, no sooner than 10 business days and no later than 14 business days after receiving the counter-notification, unless the copyright owner files an action seeking a court order to restrain you from engaging in the allegedly infringing activity.

C. Repeat Infringers

Vinkoprints has a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. This determination will be made at our sole discretion, taking into consideration various factors, including the number of DMCA notices we have received regarding a user’s activity.

D. Changes to This DMCA Policy

We reserve the right to modify this DMCA Policy at any time, with or without prior notice. We will post any changes on this page, and the “Last Updated” date will be revised accordingly. Your continued use of the Site following the posting of any changes constitutes your acceptance of the revised DMCA Policy. It is your responsibility to review this policy periodically for updates.
